New U.S. Department of the Interior Review
A new U.S. DOI review and approval process for wind and solar projects represents a departure from prior procedures but should
The policy, effective immediately and with no expiration date, requires nearly all federal actions related to wind and solar energy facilities to undergo centralized, multi-tiered review culminating in approval by the Secretary of the Interior.
This significantly increases administrative oversight and the potential for project delays. The DOI memo goes further by formally prohibiting wind and solar energy projects from using the U.S. Fish and Wildlife Service's (USFWS) Information for Planning and Consultation (IPaC) system.
On July 15, 2025, the U.S. Department of the Interior (DOI) circulated an internal memorandum, requiring 68 different DOI actions related to wind and solar project development to be submitted to the DOI Office of the Executive Secretariat and Regulatory Affairs, and then reviewed by the DOI Deputy Secretary and DOI Secretary.
This directive may also extend to coordination with state or local environmental review processes, as well as to other types of infrastructure that primarily support or are functionally tied to wind or solar projects. Federal agencies, including the U.S. Fish and Wildlife Service (USFWS), have already begun implementing this directive.
